Applicant's Original Proposal
Applications for approval of an Official Plan Amendment and a Zoning By-law Amendment have been submitted by Pickering Harbour Company Ltd., for lands located on the east side of Liverpool Road, south of Wharf Street, municipally known as 505 and 591 Liverpool Road.
The Pickering Harbour Company Ltd., is proposing a mixed-use development consisting of two buildings having heights of 23 storeys containing a total of 498 apartment units with approximately 1,900 square metres of grade related commercial uses. The proposal also includes a total of 539 parking spaces for residents, visitors and commercial uses, as well as 200 public parking spaces to serve the neighbourhood. In addition, the applicant is proposing a pedestrian promenade through the site and a public boardwalk along the waterfront edge.
The lands located at 505 Liverpool Road are owned by the City of Pickering. The City of Pickering is not a co-applicant. In order to proceed with this development, the applicant would be required to purchase 505 Liverpool Road from the City of Pickering. Complete Application Notice
Applicant's Revised Proposal
Pickering Harbour Company Ltd. has submitted a revised proposal. The following key changes have been made to the original proposal:
- the removal of the City-owned lands from the application
- reduces the building heights of the two towers from 23-storeys to 15-storeys
- reduces the number of apartment units from 498 to 377
- eliminates the 200 public parking spaces
- increases the width of the buffer area adjacent to the Hydro Marsh
- reduces the grade related retail uses to 1,400 square metres
- adds 625 square metre assembly hall/event hall
- identifies an indoor boat storage area
- increases the minimum parking for residential units from 0.8 to 1 space per unit

February 24, 2020 Council Minutes
Council Resolution #234/20:
On February 24, 2020, Council resolved that the Notice of Motion to refuse Pickering Harbour Company Ltd., to amend the City’s Official Plan and Zoning By-law for 505 and 591 Liverpool Road, be referred to City Development for consideration and to report back to the Planning & Development Committee meeting on May 4, 2020, or earlier, if deemed appropriate, in accordance with standard process utilized to review, assess and make recommendations on all planning applications.
With the on-going events regarding COVID-19 and the closure of City facilities, the May Planning & Development Committee meeting has been cancelled.

Ontario Land Tribunal (OLT)
Pickering Harbour Company Ltd. has appealed the City’s decision to the Ontario Land Tribunal (OLT) (formerly known as the Local Planning Appeal Tribunal)
OLT held a Case Management Conference (CMC) by video on Monday, February 1, 2021.
OLT issued a written decision on May 5, 2021, see decision Case No. PL200388.
A CMC is a mandatory hearing event that provides the OLT with the opportunity to identify party and participant requests, identify or narrow the issues, identify facts that may be agreed upon, and provide directions for disclosure of information. OLT will also address parties to discuss opportunities for settlement, including the possible use of mediation or other dispute resolution processes. At the CMC, the Tribunal member granted Party status to the Toronto and Region Conservation Authority (TRCA), Region of Durham and 2388116 Ontario Inc. (owner of lands municipally known as 1280, 1284 to 1288 Wharf Street and 607 Annland Street). Ontario Power Generation requested and was granted Participant status, along with 11 other individuals.
Counsel for Pickering Harbour Company Ltd. (PHC) advised the Tribunal that PHC will be filing with the Tribunal a revised application, including additional information requested by the TRCA, in June 2021.
On June 29, 2021, the agent for PHC formally submitted a revision to the application under appeal, not as a new application with the City. Subsequently, on July 5, 2021, counsel for PHC filed the revised application and supporting studies with the Tribunal formally revising the development proposal before the Tribunal. The materials filed include:

Ontario Land Tribunal (OLT) held a second Case Management Conference (CMC) by video on Monday, October 25, 2021.
OLT Issued a Written Decision on November 4, 2021, see decision Case No.PL200388
At the second CMC, the Tribunal directed legal counsel for PHC to provide the revised materials noted above, to the registered participants for their review. The revised materials have been circulated to the participants by PHC’s legal council. In addition, the City was directed to post the revised materials on the City's webpage, which are found in the links above.
The City and other Parties prepared their Issues List, and draft a Procedural Order that sets out the timing for exchange of witness lists, witness statements and other hearing items. This includes the date by which Participants must submit their Participant Statements.
The Tribunal scheduled a nine (9)-day hearing to begin on Monday, November 7, 2022. In June 2022, Legal counsel for PHC requested an adjournment of the hearing. On July 7, 2022, the Tribunal granted the request (see OLT Adjournment Letter). The basis for the request for an adjournment of the hearing was the issuance of a license for the Pickering Nuclear Generating Station (PNGS) to operate until August 31, 2028, thus further delaying the start of decommissioning and potential revision to the Nuclear Exclusion Zone which affects the PHC lands.
The Tribunal has cancelled the hearing event scheduled to commence on Monday, November 7, 2022.
The Tribunal directs the parties to provide a status update on or before Friday, July 7, 2023 as to the progress of this matter and whether an additional CMC should be scheduled at that time.

Planning Act Requirements
If a person or public body does not make an oral submission at a public meeting or make written submissions to the City of Pickering before the City of Pickering gives approval or refusal of the Official Plan Amendment and Zoning By-law Amendment, the person or public body:
i) is not entitled to appeal the decision of the Council to the Ontario Land Tribunal; and,
ii) may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
