Previously Approved Draft Plan

In 2004, the City draft approved a Draft Plan of Subdivision (18T-99011) for 20 lots fronting onto Toynevale Road, Winette Road, Pine Ridge Road and a new road running south from Toynevale Road. This approved draft plan has remained inactive since approved.

Current Proposal

The City Development Department has received applications for an Official Plan Amendment and a Zoning By-law Amendment in order to facilitate an amendment to the Draft Approved Plan of Subdivision 18T-99011. The applicant is proposing to construct 14 residential lots for detached dwelling fronting a new public road extending south from Toynevale Road terminating in a cul-de-sac.

Redline Revisions to the Draft Plan of Subdivision

The redline revisions will reflect the changes to the parcel fabric made through Land Division applications, which created new lots and severed the rear of lots in order to consolidate all of the land holdings for the draft plan. The revised draft plan proposes 14 lots fronting onto a new road running south from Toynevale Road, ending in a cul-de-sac.

Official Plan Amendment Application

The purpose of the Official Plan Amendment is to increase the maximum permitted density within the Rosebank Neighbourhood policies, from 17 units per net hectare to 19.83 units per net hectare.

Zoning By-law Amendment Application

The purpose of the Zoning By-law Amendment is to request a site-specific exception to the existing R4 - Residential Zone. The proposed site-specific exception proposes to:

  • reduce the minimum front yard from 15 metres to 12.1 metres;
  • reduce the minimum lot area from 460 square metres to 400 square metres;
  • reduce the minimum front yard setback from 7.5 metres to 4.8 metres;
  • reduce the minimum side yard setbacks from 1.5 metres to 1.2 metres; and,
  • increase the maximum lot coverage from 33 percent to 45 percent.

i)   is not entitled to appeal the decision of the Council to the Local Planning Appeal Tribunal; and,

ii)  may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
