The Ontario Land Tribunal has upheld the City's approval of the "Infill and Replacement Housing in Established Neighbourhoods" amendment to its Official Plan and zoning by-laws. These amendments add new policies, mapping and provisions, and revise existing policies, mapping and provisions, to implement the Council-endorsed Infill and Replacement Housing in Established Neighbourhoods Study . These amendments apply to lands located within proposed Established Neighbourhood Precincts in Wards 1, 2, and 3.

Background
Ontario Land Tribunal Decision - September 5, 2023On September 13, 2021, the Planning & Development Committee approved Recommendation Report PLN 33-21
On September 27, 2021, Council approved an amendment to Zoning By-laws 2511, 2520, and 3036, to increase the maximum Dwelling Height within Established Neighbourhood Precincts from 9.0 to 10.0 metres.
On October 25, 2021, Council adopted Revised Urban Design Guidelines for Infill & Replacement Housing in Established Neighbourhood Precincts, August 2021.
On October 25, 2021 Council also reconsidered its decision of September 27, 2021, and directed staff to initiate an amendment to reduce the maximum Dwelling Height provision from 10.0 to 9.0 metres within Established Neighbourhood Precincts, in accordance with the original recommendations of Report PLN 33-21of the Planning & Development Committee of September 13, 2021.
Council subsequently approved amendments to the respective zoning by-laws that reduced the maximum dwelling height from 10.0 to 9.0 metres.

Infill and Replacement Housing Study
A public engagement process was begun in March, 2019, which included three public open houses (two in-person and one virtual) and three update reports at the Planning and Development Committee.
The engagement process concluded with a final recommendation report, prepared by SGL Planning & Design Inc., which was presented at the Planning and Development Committee on September 14, 2020.
- Infill and Replacement Housing in Established Neighbourhoods, Planning Recommendations Report, August 2020
On September 28, 2020, Council:
- endorsed the Infill and Replacement Housing in Established Neighbourhoods, Planning Recommendations Report, prepared by SGL Planning & Design Inc., dated August 2020;
- authorized City staff to:
- initiate the recommended Official Plan and Zoning By-law Amendment processes;
- undertake the necessary steps to implement the recommended by-law to restrict the width of driveways in the public right-of-way; and
- investigate the implementation of a by-law for the protection of trees on private property and report back to Council in mid-2021; and
- adopted the Urban Design Guidelines for Infill and Replacement Housing in Established Neighbourhood Precincts, August 2020.*
